Terms of Service

1. Agreement to Terms

By downloading, installing, or using the Kitchelin mobile application or visiting kitchelin.com (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. The Service is operated by Kitchelin (“we,” “us,” or “our”).

2. Description of the Service

Kitchelin is an AI-powered cooking assistant that generates recipes from your available ingredients, provides a voice-guided Sous-Chef to walk you through each step, and helps you manage your kitchen inventory. The Service uses artificial intelligence and third-party APIs to deliver its features.

3. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Accounts and Authentication

You may sign in using your Google or Apple account. You are responsible for maintaining the security of your account credentials. You agree not to share your account with others or allow unauthorized access. We are not liable for any loss or damage arising from unauthorized use of your account.

5. Subscriptions and Payments

Kitchelin offers a free tier and paid subscription plans (Pro and Premium). Paid subscriptions are billed on a recurring monthly basis through the Apple App Store or Stripe, depending on your platform.

• Free: Up to 7 recipes and 7 Sous-Chef messages per week with basic features.
• Pro ($8/month): Up to 50 recipes and 20 Sous-Chef messages per week, voice Sous-Chef, and kitchen inventory.
• Premium ($20/month): Unlimited recipes and up to 40 Sous-Chef messages per week, premium voice, priority support, and all Pro features.

Prices are in US Dollars and may vary by region. We reserve the right to change pricing with reasonable notice. Subscription renewals are charged automatically unless canceled at least 24 hours before the end of the current billing period.

6. Cancellations and Refunds

You may cancel your subscription at any time through your Apple ID subscription settings or your Stripe billing portal. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods. Refunds for Apple App Store purchases are governed by Apple’s refund policies.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or extract source code from the Service.
• Circumvent usage limits, rate limits, or access controls.
• Use automated tools, bots, or scrapers to access the Service.
• Resell, redistribute, or sublicense access to the Service.
• Transmit malicious code or interfere with the operation of the Service.

8. AI-Generated Content

Recipes, cooking instructions, substitution suggestions, and other content generated by Kitchelin are produced by artificial intelligence and are provided for informational purposes only. We do not guarantee the accuracy, completeness, safety, or nutritional information of AI-generated content.

Food safety: While the Sous-Chef attempts to flag food safety concerns (such as undercooked poultry or unsafe holding temperatures), you are solely responsible for ensuring that food is prepared and stored safely. Always use a food thermometer and follow established food safety guidelines from your local health authority.

Allergies and dietary restrictions: Kitchelin does not guarantee that generated recipes are free of allergens or suitable for specific dietary needs. Always verify ingredients if you have allergies or dietary restrictions.

9. Intellectual Property

The Kitchelin name, logo, app design, and underlying technology are our property or the property of our licensors and are protected by intellectual property laws. You retain ownership of any photos you take or content you submit through the Service, but you grant us a limited license to process that content as needed to provide the Service.

10. Third-Party Services

Kitchelin relies on third-party services including OpenAI (for recipe generation and voice transcription), ElevenLabs (for text-to-speech), Google and Apple (for authentication), and Stripe (for payment processing). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.

11. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time without prior notice. We are not liable for any downtime, data loss, or service interruptions.

12. Limitation of Liability

To the maximum extent permitted by law, Kitchelin and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising out of or related to your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated recipes will meet your expectations or dietary needs.

14. Indemnification

You agree to indemnify and hold harmless Kitchelin from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Any provisions of these Terms that by their nature should survive termination will survive, including sections on liability, indemnification, and dispute resolution.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
